Welcome to AI Creativ Agency LLC (“AI Creativ,” “we,” “us,” or “our”). We provide artificial-intelligence-driven advertising, lead-generation, automation, and virtual-agent services designed to help businesses scale. By accessing aicreativagency.com or using any of our services—including our SMS and e-mail program AI Creativ Alerts—you agree to these Terms of Service (“Terms”). If you do not agree, please do not use our services.

2. Eligibility & Account Responsibilities

You must be at least 18 years old and have authority to bind the business you represent. Keep login credentials confidential and notify us immediately of unauthorized use.

3. Our Services

We provide:

• Paid and free consulting on AI automation, ad strategy, and lead funnels.
• Software integrations, chat-based AI agents, and related support.
• AI Creativ Alerts mobile messaging (see §7).

We may update or discontinue features at any time.

4. Payments & Refunds

At launch we collect no payments directly on this site; future paid plans will be processed through Stripe or Whop under separate checkout terms that will disclose price, billing cycle, and refund windows before purchase. All fees are in U.S. dollars.

5. Intellectual Property

All site content, software, logos, and documentation are owned by AI Creativ or its licensors. You receive a limited, non-transferable license to access the site solely for your internal business use.

Our AI tools can accelerate marketing workflows, but performance varies by business, creative assets, and market conditions. No specific leads, revenue, or performance results are guaranteed. Human oversight is available via the support channels below.

You will not:

• (i) upload malicious code;
• (ii) infringe intellectual-property rights;
• (iii) use our services for unlawful, deceptive, or spam activity; or
• (iv) violate any app-store, carrier, or advertising-platform policies.

9. Limitation of Liability

To the maximum extent permitted by law, AI Creativ's total liability under these Terms will not exceed the greater of (a) USD 100 or (b) the amount you paid us in the 12 months preceding the claim. We are not liable for indirect or consequential damages.

10. Dispute Resolution & Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. You agree to resolve any dispute exclusively in state or federal courts located in Harris County, Texas, and waive any objection to personal jurisdiction there.

11. Changes

We may modify these Terms at any time. Material changes will be posted at least 10 days before they take effect. Continued use after the effective date constitutes acceptance.
